LEASE AGREEMENT

THIS LEASE AGREEMENT is entered into on [Date] by and between:

In respect of the property known as [Property Address] ("the Premises"), being a [Property Type] property.

1. TERM

1.1 The lease shall commence on [Start Date] and end on [End Date] ("the Lease Period").

1.2 Thereafter, the lease shall continue on a month-to-month basis unless either party gives [Notice Period] days' written notice of termination.

2. RENT AND DEPOSIT

2.1 The monthly rent shall be [Rent], payable on or before the [Day] of each month.

2.2 A deposit of [Deposit] shall be paid upon signing. The deposit shall be held in an interest-bearing account and refunded within 14 days of lease termination, less any deductions for damages.

2.3 Rent shall escalate annually by [Escalation]% on each anniversary of the lease start date.

2.4 A late payment fee of [Late Fee] shall be charged if rent is not received by the due date.

3. USE OF PROPERTY

3.1 The Premises shall be used as a private residence only and for no other purpose.

3.2 The maximum number of occupants shall be [Occupants] persons.

3.3 The Tenant shall not cause any nuisance or disturbance to neighbours.

3.4 The Tenant shall keep the Premises in a clean and tidy condition.

4. OBLIGATIONS OF THE LANDLORD

4.1 The Landlord warrants that the Premises are in a habitable condition and comply with all health and safety requirements.

4.2 The Landlord shall maintain the structural integrity of the Premises, including the roof, walls, foundations, and major systems (plumbing, electrical).

4.3 The Landlord shall ensure the Premises are provided with running water and electricity.

5. OBLIGATIONS OF THE TENANT

5.1 The Tenant shall pay rent and all utilities on time.

5.2 The Tenant shall keep the Premises clean and report any defects or maintenance issues promptly.

5.3 The Tenant shall not make any alterations to the Premises without the Landlord's prior written consent.

5.4 The Tenant shall not use the Premises for any illegal activity.

6. DEFAULT

6.1 The Tenant shall be in default if rent is unpaid for 7 (seven) days after the due date.

6.2 Upon default, the Landlord may: (a) terminate the lease; (b) claim all arrears; (c) institute eviction proceedings in terms of the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, 1998.

7. GENERAL

7.1 This Agreement constitutes the entire agreement between the parties.

7.2 This Agreement shall be governed by the laws of the Republic of South Africa and the Rental Housing Act, 1999.

7.3 The Landlord shall provide the Tenant with a signed copy of this lease and a receipt for the deposit.
